Some examples are Apple computers, Domino sugar, and Diesel jeans. Since fanciful and arbitrary marks are inherently distinctive, they are provided the highest degree of protection.

Suggestive trademarks also are afforded a high degree of protection since they evoke but do not directly describe a defining characteristic of the product. Well known examples include Coppertone, 7-11, and Greyhound. It may be difficult to discern the difference between suggestive and descriptive marks, but if a mark requires imagination, thought, and perception, it is suggestive rather than descriptive. Since descriptive trademarks literally describe the product, they are not inherently distinctive and must acquire a secondary meaning in order to be protected. A secondary meaning is formed when consumers associate the term with a particular provider of goods and services. Holiday Inn, American Airlines, and Dell Computers are all descriptive trademarks.

Lastly, a generic mark is the common name for goods or services and does not possess any distinguishing character. Salt, personal computers, and shredded wheat are all examples of generic terms that are not protected by trademark law.

3. Trademark rights and registration. The first time you use your trademark in conjunction with the sale of your goods or services, you can claim your rights to use it. You are not required to register your trademark in order to assert ownership, but if you want to receive the full rights afforded to you by trademark law, it is an excellent idea. Unregistered trademarks are represented by and unregistered service marks are signified by ?. Registered trademarks are indicated by ? and can only be used after your mark has been officially registered with the government, not prior to your application or while it is pending. In 1979, the Ninth District Court of appeals established the following criteria in order to determine likelihood for confusion:

Strength of the mark, Proximity of goods, Similarity of the marks, Evidence of actual confusions, Marketing channels used, Type of goods and the degree of care likely to be exercised by the purchaser, Defendant?s intent in selecting the mark, Likelihood of expansion of the product lines. Scientists shocked by behavior of rare gray whale (AP)

ANCHORAGE, Alaska ? Scientists tracking a rare western Pacific gray whale were shocked last winter when the endangered animal left the Asian coast, crossed the Bering Sea and swam south along Alaska, British Columbia and the Pacific Northwest coasts.

Researchers are back in Russia to see whether the feat will be repeated by other Pacific gray whales.

A science team coordinated by the International Whaling Commission has attached satellite tags to five more of the highly endangered whales, according to an announcement by Oregon State University, which is taking part in the study. Researchers hope to tag 10 more whales before field work concludes.

Only about 130 western Pacific gray whales remain and little is known of their winter habits. They spend summers near Russia's Sahkalin Island. They face threats from offshore petroleum development, according to environmental groups.

Researchers last October were limited by foul weather to placing a cigar-size satellite tag on just one whale on the last day of field work. The 13-year-old male was dubbed "Flex." It spent more than two months feeding near Sakhalin Island before moving across the Sea of Okhotsk to the west coast of the Kamchatka Peninsula.

On Jan. 3, to the surprise of researchers, it began swimming steadily east across the Bering Sea. Eighty miles north of Alaska's Pribilof Islands, the whale turned south, and swam between Aleutian Islands into the Gulf of Alaska. It continued southeast to shallow coastal waters off Washington and Oregon. Its last confirmed location was Feb. 4 off Siletz Bay, Ore., where researchers believe the satellite tag fell off. The whale had traveled 5,335 miles over 124 days.

Bruce Mate, director of the Marine Mammal Institute at Oregon State University, told The Associated Press in January that little was known about the winter habits of western Pacific gray whales. One hypothesis was that they swam south down the Asian coast to the southeast China Sea. Tracking one to North America waters was "surprising everybody," he said in January.

Marine researchers later determined that Flex had crossed the Pacific at least once before. Researchers sent a photo of Flex to Cascadia Research Collective, a scientific and education organization based in Olympia, Wash., which matched the photo to a whale photographed in 2008 off Canada's Vancouver Island.

Mate is again part of the research team and is leading the tagging portion. He said by e-mail Wednesday that weather will again be a factor in how many whales are tagged.

"We are having weather issues for sure (one day on the water in the last 8 days)," he wrote. "It will probably get worse as we continue, just because it is September, but we will not stay more than another 9 days."

The effort also includes scientists from the A.N. Severtsov Institute of Ecology and Evolution of the Russian Academy of Sciences and the U.S. National Marine Fisheries Service.

Like last year, the public will be able to track tagged whales through weekly updates posted in English at http://mmi.oregonstate.edu/Sakhalin2011 and in Russian at http://kit.sevin-expedition.ru/news/news_69.html. A tag on one whale was not completely attached, according to the Oregon State website, and may have fallen off.

Results of NY House race coming in slowly (AP)

NEW YORK ? Democrat David Weprin faced an unusually tight race against Republican Bob Turner in a special election Tuesday in New York's heavily Democratic 9th Congressional District, where voters unhappy with President Barack Obama could elect a Republican for the first time.

The contest to replace disgraced Democratic Rep. Anthony Weiner, who resigned in a sexting scandal, had become too close to call, with public opinion polling showing a slight edge for Turner, a retired media executive with no previous political experience.

Both candidates hit the streets Tuesday, meeting voters and trying to boost turnout, the key in most special elections. Weprin had a full public schedule of get-out-the-vote events, while Turner's only scheduled public appearances were his vote Tuesday morning and an after-the-vote party at a restaurant. His campaign said he would be out in the district all day drumming up support.

Polls closed at 9 p.m., and results trickled in slowly. The state replaced outdated lever-operated voting machines last year in favor of paper ballots and optical scanners, which take more time to close and process.

With more than 30 percent of precincts reporting late Tuesday night, Turner held a slight lead over Weprin.

Panicked at the prospect of an embarrassing loss, Democrats poured cash into the race and sent in their stars to try to save Weprin, a state lawmaker who was forced to defend Obama's economic policies even as he tried to stress his own independence and close ties to the community.

Republicans worked to frame the race as a referendum on Obama, even though turnout is usually low in a special congressional election.

"It wasn't planned that way, but this is the only nationally contested election on the federal level, so it is, in a way, a referendum on President Obama's policies," Turner said Tuesday.

Nevada also had a House election Tuesday after a shake-up that started with Republican Sen. John Ensign's resignation amid a sex scandal.

On Monday, House Republican Leader Eric Cantor argued that a Turner victory would be an "unprecedented win" and the latest evidence of voter dissatisfaction with Obama.

"That district is not unlike the rest of the country. People are very unhappy with the economy tight now, and, frankly, I would say unhappy with the lack of leadership on the part of this White House," Cantor, of Virginia, told reporters in the Capitol.

Back in the district that spans parts of Queens and Brooklyn, Turner campaigned with Rudolph Giuliani, the popular former Republican mayor.

There also were six special elections for vacant state Assembly seats and several local races on the ballot around the state.

Weprin campaigned at a senior center Tuesday and greeted voters at a subway stop with Democrats including U.S. Rep. Jerrold Nadler.

With a large population of Catholic and Orthodox Jewish residents, the 9th Congressional District is broadly blue collar and more conservative than many others in the city. It's the kind of white, working-class environment that Obama struggled with in his 2008 campaign even as he was easily winning most other traditional Democratic constituencies.

A Siena Poll released Friday showed Turner leading Weprin among likely voters, with a 50 to 44 percent margin. The same poll found just 43 percent of voters approving of Obama's job performance, while 54 percent said they disapproved. The president fared much worse among independents. Just 29 percent said they approved of his job performance, while 68 percent disapproved.

On Tuesday, Weprin said the polished Democratic machinery would get people to the polls.

"We have a lot of people with us, and I think we are going to pull out the votes," he said. "I think the polls are not going to reflect who's going to come out to vote."

Hoping to shift the momentum in the final days, the Democratic Congressional Campaign Committee invested more than $500,000 in ads in New York's pricey television market. An independent Democratic group, the House Majority PAC, ran ads, too. And Obama for America, part of the Democratic National Committee that support the president's re-election, urged volunteers to rally behind Weprin.

The party also enlisted two of its biggest guns, former President Bill Clinton and Gov. Andrew Cuomo, to record phone calls for Weprin. And Democrats relied on organized labor and other affiliated groups to bring voters to the polls.

"When voters learn the real difference between David Weprin and Bob Turner, they'll vote their Democratic values," DCCC spokeswoman Jennifer Crider said.

Weprin tried to cast Turner as hostile to popular entitlement programs such as Social Security and Medicare. It's a formula that worked for another Democrat, Kathy Hochul, who won a heavily Republican upstate New York district in a special election last May by vowing to protect those programs.

But Weprin, an orthodox Jew, was on the defensive on gay marriage and Israel, which could have peeled away some support from the Orthodox community. He voted in favor of same-sex nuptials in the New York Assembly, and some Jewish voters threatened to withhold support for Weprin because they disapprove of Obama's policies toward the Jewish state. Former Mayor Ed Koch, a Democrat, endorsed Turner.

"Rightly or wrongly, it is (part of the race)," Turner said Tuesday. "This president has been less friendly than any other president in recent history, and I think today voters can hold him to account for it."

The House seat opened up in June, when Weiner was pushed by party leaders to resign after sending sexually provocative tweets and text messages to women he met online.

The trouble for Weiner, who served seven terms, began when a photo of a man's crotch surfaced on his Twitter feed. He initially denied the photo was of him but later admitted it was.

First proof in patients of an improved 'magic bullet' for cancer detection and radio-therapy

ScienceDaily (Sep. 12, 2011) ? Oncologists have long sought a powerful "magic bullet" that can find tumors wherever they hide in the body so that they can be imaged and then destroyed. Until recently scientists accepted the notion that such an agent, an agonist, needed to enter and accumulate in the cancerous cells to act. An international research team has now shown in cancer patients that an investigational agent that sticks onto the surface of tumor cells without triggering internalization, an antagonist, may be safer and even more effective than agonists.

One of the Salk Institute's leading researchers, Dr. Jean Rivier, professor in The Clayton Foundation Laboratories for Peptide Biology and holder of the Frederik Paulsen Chair in Neurosciences and his Swiss collaborator, Dr. Jean Claude Reubi, University of Berne and Adjunct Professor at Salk, co-authored a pilot study, published in the September issue of the Journal of Nuclear Medicine, of five patients and demonstrated that their "antagonist," 111In-DOTA-BASS, outperformed the "agonist" agent, OctreoScan, that is widely used in the clinic to image neuroendocrine tumors bearing somatostatin receptors.

"This is the first proof of principle in humans that labeled peptide antagonists can effectively image tumors. Additional research suggests that we could one day use a different radioactive metal to effectively kill the tumors," said Dr. Rivier.

Dr. Reubi, a molecular pathologist, and Dr. Rivier, a chemist, collaborated in the design and selection of natIn-DOTA-BASS for human testing, and Dr. Helmut R. Maecke, a radio chemist, loaded DOTA-BASS with its radioactive marker and tested the compound before use in human. Afterward, the "first in man" study with the radioactive loaded DOTA-BASS was performed at the University Hospital in Freiburgby Drs. Damian Wild, Melpomeni Fani, Martin Behe, Ingo Brink, Helmut R. Maecke, and Wolfgang A. Weber.

The genesis of this study goes back to 1973, when a team of Salk researchers, which included Drs. Brazeau, Vale, Burgus, Rivier, and Roger Guillemin, a 1977 Nobel laureate, isolated and characterized somatostatin, a peptide produced by neuroendocrine glands. The scientists found that the normal function of somatostatin is to block the release of growth hormone throughout the body, which includes inhibiting the release of thyroid-stimulating hormone (TSH) from the thyroid.

Drs. Rivier, Reubi and their colleagues from Germany showed that 111In-DOTA-BASS bound to a greater number of somatostatin receptors on cancer cells than the agonist OctreoScan, and that it did accumulate in normal tissue (liver and kidney) to a lesser extent.

The prototype antagonist therapy has been revamped, and the version studied in the Journal of Nuclear Medicine publication, 111In-DOTA-BASS, detected 25 of 28 metastatic neuroendocrine tumors in the patients, whereas OctreoScan detected only 17.

In-DOTA-BASS has been licensed to a pharmaceutical company for clinical trial development, according to Rivier, who adds that other researchers are exploring an antagonist approach for other G-protein coupled receptors that are abundantly expressed on cancer cells.

The study was funded in part by the Swiss National Science Foundation (JCR).

America mourns Sept 11 dead with somber ceremonies (Reuters)

NEW YORK (Reuters) ? Children yearned for lost parents and grown men and women sobbed in raw grief on the brass bearing the names of nearly 3,000 dead as America commemorated the 10th anniversary of the September 11 attacks.

The name of every person killed in al Qaeda's hijacked plane attacks was read on Sunday in the nearly five-hour-long centerpiece of a heart-wrenching ceremony where the World Trade Center twin towers stood.

"I haven't stopped missing my Dad. He was awesome," said Peter Negron, a child when his father, Pete, was killed in one of the towers. "I wish my Dad had been there to teach me how to drive, ask a girl out on a date and see me graduate from high school and a hundred other things I can't even begin to name."

There were smaller ceremonies in Shanksville, Pennsylvania, and at the Pentagon, the other sites were 19 men from the Islamic militant group al Qaeda crashed hijacked airliners on the sunny Tuesday morning of September 11, 2001.

The attacks led U.S. forces to invade Afghanistan to topple the Taliban rulers who had harbored al Qaeda leader Osama bin Laden and Washington began a "war on terror" that ousted Iraq's Saddam Hussein and persists on several fronts to this day.

"Ten years have passed since a perfect blue sky morning turned into the blackest of nights," New York Mayor Michael Bloomberg said at New York's Ground Zero.

"Since then, we've lived in sunshine and in shadow, and although we can never unsee what happened here, we can also see that children who lost their parents have grown into young adults, grandchildren have been born and good works and public service have taken root to honor those we loved and lost."

Thousands gathered at the site on a clear morning to grieve. With security tight and no traffic, there was an eerie silence where the 110-story skyscrapers collapsed a decade ago, sending a noxious cloud over lower Manhattan.

President Barack Obama, who visited all three attack sites, read from Psalm 46 in New York: "God is our refuge and strength."

Speaking at an evening concert in Washington that closed out a day of memorial observances, Obama said much had changed for Americans in the 10 years since September 11, 2001.

"We can never get back the lives we lost on that day, or the Americans who made the ultimate sacrifice in the wars that followed," Obama said. "Yet today, it is worth remembering what has not changed. Our character as a nation has not changed."

RUBBING NAMES

The ceremony in New York -- with the wail of bagpipes, youthful voices singing the national anthem and firefighters holding aloft a tattered American flag retrieved from Ground Zero -- drew tears. Family members wore T-shirts with the faces of the dead, carried photos, flowers and flags in an outpouring of emotion.

For the first time, relatives saw the just-finished memorial and touched the stone where the names of their dead loved ones were etched. Some left flowers, others small teddy bears. Some used pencils to rub the names on paper, some took pictures, others leaned against the stone and cried.

The names of the dead were read by wives and husbands, fathers, mothers, sisters, brothers and children, some choked with emotion.

"May your soul finally rest in peace. Your son Nathan and I, as the years go by, grow strong. Goodbye, my dear friend, my teacher and my hero," said Candy Glazer.

Glazer's husband, Edmund Glazer, cheerfully called his wife from Flight 11 not long before he died when the plane hit the north tower -- the first of that day's horrific events.

Nicholas Gorki, 9, had these words for the father he never met, Sebastian Gorki, who died at the World Trade Center while his wife was still pregnant: "You gave me the gift of life and I wish you could be here to enjoy it with me."

The September 11 attacks claimed the lives of people from more than 90 countries. They were followed by al Qaeda bombing assaults in London, Madrid and elsewhere and brought an international campaign to ferret out their members.

"God bless every soul that we lost," said former New York City Mayor Rudolph Giuliani, who was called "America's mayor" for his leadership after the attacks.

"SO MANY NAMES ..."

The New York memorial includes two plazas in the shape of the footprints of the twin towers with cascading 30 foot waterfalls. Around the perimeters of pools in the center of each plaza are the names of the victims of the 2001 attacks and an earlier attack at the trade center in 1993.

Obama visited the North Memorial Pool in the footprint of the north tower. He walked around it hand-in-hand with first lady Michelle Obama, former President George W. Bush and his wife, Laura. Obama touched the etched names of the dead before he greeted some family members.

"So many names, there is barely room on the walls of the heart," said former New York Governor George Pataki, reading from the Billy Collins poem "The Names."

Police in New York and Washington were on high alert against what authorities called a "credible but unconfirmed" threat of an al Qaeda plot to attack the United States again on the 10th anniversary.

The U.S. military said it scrambled two F-16s to accompany an aircraft flying from Los Angeles to JFK airport in New York after reports of suspicious activity, and the U.S. Secret Service said it was looking into threatening messages posted on the White House's Facebook page.

At Shanksville, Obama laid a wreath where a plane crashed after passengers overwhelmed hijackers intent on piloting it into the White House or U.S. Capitol. Chants of "USA, USA" broke out from the crowd, gathered at the foot of a grassy hill. The Obamas talked with family members. "Thank you for keeping us safe," one man called out to the president.

Pennsylvania Governor Tom Corbett said the passengers on Flight 93 -- remembered forever in Todd Beamer's "Let's roll" rallying cry -- "set a new standard for American bravery."

Later at the Pentagon, Obama placed a wreath of white flowers at the memorial, which says "September 11, 2001 9:37 AM" to mark the time the plane struck the U.S. military's headquarters.

POPE URGES "REJECT VIOLENCE"

In the Adriatic city of Ancona, Italy, Pope Benedict prayed for September 11 victims and appealed to those with grievances to "always reject violence."

In May, nearly a decade after September 11, U.S. forces killed al Qaeda founder bin Laden at his hide-out in Pakistan. The 2001 attacks prompted wars in Iraq and Afghanistan, where the Pentagon still has a large number of troops and where violence persists.

"The 9/11 attacks were the beginning of a long winter in world history," NATO Secretary-General Anders Fogh Rasmussen said in Brussels. "But events in the Middle East have renewed our faith that although the desire for freedom can be repressed, it can never be extinguished. The Arab spring is a new season of hope for us all."

There were moments of silence in the Ground Zero ceremony marking when the planes hit the twin towers as well as when they collapsed. Other moments of silence were marked when the plane hit the Pentagon and the fourth crashed in Shanksville.

After a faltering start at rebuilding, the new One World Trade Center is now more than 80 stories above the ground as it rises to its planned 1,776-foot height -- symbolic of the year of America's independence from Britain.

For many -- particularly the more than 1,100 families who received no remains of their dead -- Sunday was the closest they came to a funeral for their loved ones. With the memorial complete, it offered for the first time something resembling a final resting place and a formal place to mourn.

"When we came out here 10 years ago there was a hole in the earth and that's how we felt," said Dakota Hale, 25, of Denver, who lost his stepfather, flight attendant Alfred Marchand.
